Prosecutors’ association challenges proposal for closing of specialized court and prosecutors‘ office

Photo: archive

The Association of Prosecutors in Bulgaria has approached the European Commission, the European Parliament, the Venice Commission and the ambassadors of the EU countries, USA and Great Britain in Sofia regarding “inadmissible interference in the independence of the judiciary”.

According to the association the proposed amendments regarding the court and the prosecution “jeopardize the rule of law and the separation of powers”, have not been subject to any public debate and are “an inadmissible attempt at political interference in the constitutional independence of the judiciary”.

The magistrates point out that the proposals for amendments to the constitution submitted by the MPs from Democratic Bulgaria change elements of the form of governance, which, by a Constitutional Court decision, is a prerogative of a Grand and not an ordinary National Assembly.
