Court declares a decision of 45th National Assemby inadmissible

The Constitutional Court has declared "inadmissible" the decision of the 45th parliament to impose a moratorium on deals and appointments made by the government of former Prime Minister Boyko Borissov. The GERB party challenged the decision in court. The decision of MPs back then suspended all appointments in the judiciary.

According to the magistrates, it was inadmissible for the National Assembly to suspend the exercise of the powers of the president and the executive branch established by the constitution and the laws.

However, saying that the subject matter of the request does not exist because the moratorium had been in effect until the appointment of a caretaker government, the Constitutional Court rejected the request for declaring the decision "unconstitutional".
