EU Court of Justice: Bulgaria should issue an identity document to a child of same-sex parents

Photo: Archive

The Court of Justice of the European Union has ruled that Bulgaria must issue an identification document or passport to a baby with parents of the same sex. The girl was born 2 years ago in Spain, but one parent is Bulgarian and the other is from Gibraltar. The child cannot obtain a passport in Spain because the parents are not Spanish, nor in Gibraltar or the UK because she was not born there. The only possibility remains Bulgarian citizenship, but the problems come from the fact that Bulgarian law does not accept same-sex marriages and does not recognize such marriages conducted abroad.

The parents filed a lawsuit in the Sofia Administrative Court, which, in turn, asked for clarification from the EU Court.

Now the Sofia Administrative Court has to decide in accordance with the European position.
